1. Our role under HIPAA

Physician Care Solutions LLC acts as a Business Associate, as defined under the Health Insurance Portability and Accountability Act (HIPAA), for covered entity clients whose Protected Health Information (PHI) we access in the course of providing medical coding, billing, and revenue cycle management services. [TODO: confirm this characterization with counsel based on actual service scope.]

2. Business Associate Agreements

We execute a Business Associate Agreement (BAA) with each covered entity client prior to accessing PHI. [TODO: confirm BAA process and attach template for counsel review.]

3. Safeguards

  • Encryption of PHI in transit and at rest.
  • Role-based access controls limiting PHI access to authorized personnel only.
  • Audit logging of system access involving PHI.
  • [TODO: list specific technical, administrative, and physical safeguards in detail, reviewed by a compliance officer.]

4. Workforce training

Staff with access to PHI complete HIPAA training [TODO: specify cadence, e.g. annually] and sign confidentiality agreements as a condition of employment.

5. Breach notification

In the event of a breach involving PHI, we follow breach notification procedures consistent with the HITECH Act and applicable state law. [TODO: insert specific notification timeline and process with counsel.]
